TERMS OF SERVICE

Mestric Guitars

Effective Date: 1 May 2026

1. Acceptance of Terms

By accessing or using the Mestric Guitars website at www.mestricguitars.com (the "Site") or placing an order for any product offered by Mestric Guitars, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site or place an order.

These Terms constitute a legally binding agreement between you and Port Macquarie Music Pty Ltd (trustee for Port Macquarie Music Unit Trust) trading as Mestric Guitars ("we", "us", "our"). We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site following any changes constitutes acceptance of those changes.

2. About Mestric Guitars

Mestric Guitars produces handcrafted boutique aged electric guitars from Port Macquarie, New South Wales, Australia. Each instrument is individually designed, built, and finished by Rob Mestric. All guitars are produced in strictly limited numbers and are sold as individually numbered artisan instruments.

Due to the handcrafted and limited-edition nature of our products, availability is subject to change without notice. We reserve the right to withdraw any product from sale at any time.

3. Products and Descriptions

We take care to ensure that all product descriptions, specifications, and images on the Site are accurate at the time of publication. However:

  • Each guitar is a handmade, one-of-a-kind instrument. Minor variations in appearance, finish, and materials may exist between what is depicted on the Site and the instrument delivered.
  • Aged finishes, wear detail, and relic work are intentional features of our instruments. The specific character of aging may vary from images shown.
  • All specifications (body wood, neck wood, fingerboard, electronics, and hardware) are listed in good faith and are subject to change at our discretion where equivalent or superior materials are substituted.
  • Weights, measurements, and other technical details are approximate.

We are not responsible for any inaccuracies resulting from third-party content, external links, or information provided by customers.

4. Pricing and Currency

All prices displayed on the Site are in Australian Dollars (AUD) and include Goods and Services Tax (GST) where applicable. Mestric Guitars is based in Australia and all transactions are processed in AUD.

For international customers, your bank or payment provider may charge currency conversion fees. These fees are not within our control and are the responsibility of the buyer.

We reserve the right to change prices at any time without notice. The price applicable to your order is the price shown at the time you complete your purchase.

5. Orders and Payment

5.1 Placing an Order

By submitting an order, you are making an offer to purchase the specified product at the stated price. We reserve the right to accept or decline any order at our sole discretion.

An order is confirmed only when you receive a written order confirmation from us via email. We are not obligated to fulfil any order prior to issuing this confirmation.

5.2 Payment

Full payment is required at the time of ordering unless a separate written agreement has been made. We accept payment methods as displayed at checkout. All payment details are processed securely.

We reserve the right to cancel any order where payment cannot be verified or is fraudulent.

5.3 Custom Orders and Deposits

Where a custom build or pre-order arrangement is agreed in writing, deposit and payment terms will be specified in that agreement. Deposits are non-refundable unless we are unable to fulfil the order.

6. Shipping and Delivery

Mestric Guitars ships domestically within Australia and internationally. Shipping costs and estimated delivery times are provided at checkout or, for high-value orders, communicated directly.

Given the nature and value of our instruments, all guitars are professionally packed and shipped with appropriate insurance. You are responsible for being available to receive the delivery and for ensuring the delivery address provided is correct.

We are not liable for delays caused by carriers, customs, or circumstances outside our control. Risk of loss passes to you upon delivery to the carrier.

For international orders, the buyer is responsible for all import duties, taxes, and customs clearance fees applicable in their country.

7. Returns and Refunds

7.1 Change of Mind

Due to the custom, handcrafted, and limited-edition nature of our instruments, we do not accept returns or offer refunds for change of mind. Please ensure you review all product information carefully before placing your order.

We are available to answer any questions prior to purchase. Contact us at info@mestricguitars.com.au before placing your order if you have any concerns.

7.2 Faulty or Damaged Goods

If your guitar arrives damaged in transit, please report it to us within 24 hours of receiving it so we can lodge an insurance claim with the courier. If you suspect a manufacturing defect, please contact us within 7 days of receipt with photographs and a description of the issue. We will work with you to arrange an appropriate remedy, which may include repair, replacement, or refund at our discretion.

We do not cover damage resulting from improper storage, environmental conditions, modification, or misuse.

7.3 Australian Consumer Law

Nothing in these Terms limits your rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Our goods come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
